About capacity & legal evaluations

Legal proceedings often turn on clinical questions: Does this person have the cognitive capacity to make their own medical or financial decisions? Are they competent to stand trial or manage their own affairs? Can they provide reliable, informed consent? We provide psychological evaluations that answer these questions with precision, in the format attorneys and courts require.

Our capacity and legal evaluations include competency-to-stand-trial assessments, guardianship evaluations, capacity-to-consent evaluations for medical or financial decisions, and psychological risk assessments. Each evaluation includes a clinical interview, standardized psychological and cognitive testing, record review, and a written report formatted for legal use. Upon request, Dr. Diaz is available to provide expert testimony in depositions and court proceedings.

Frequently asked questions

A capacity evaluation is a clinical assessment of an individual's cognitive and psychological ability to make specific decisions — such as medical treatment, financial management, or legal proceedings. It answers the question: does this person currently have the mental capacity to understand, reason, and communicate a decision? These evaluations are used in guardianship, estate, and medical decision-making contexts.

A competency-to-stand-trial evaluation assesses whether a defendant currently has a rational and factual understanding of the charges against them and the ability to assist their attorney in their defense — as required by Florida and federal law. These evaluations are conducted by a licensed psychologist and reported to the referring court or attorney.

Yes.
